Welcome to the Tool Room website. By continuing to browse and use this website, you agree to comply with and be bound by the following terms and conditions, which together with our Privacy  Policy govern Tool Room’s relationship with you in relation to this website. If you do not agree with any part of these terms, please refrain from using the site. 

1. Website Use  

• The content of this website is provided for general information only and is subject to  change without notice.
• Neither Tool Room (trading as Gaffa Creative Precinct) nor third parties provide any  warranty or guarantee as to the accuracy, timeliness, performance, completeness, or  suitability of the information and materials available on this site. We expressly exclude  liability for inaccuracies or errors to the fullest extent permitted by law.
• Your use of any information or materials from this website is entirely at your own risk. It is  your responsibility to ensure that any products, services, or information available meet  your specific requirements.
• Unauthorised use of this website may give rise to a claim for damages and/or constitute a criminal offence.
• From time to time, the website may include links to external sites. These links are provided for convenience only and do not imply endorsement. We accept no responsibility for the content of linked sites.

2. Orders, Pricing and Payment  

• All orders placed through our website are subject to availability and confirmation of  payment.
• A contract is formed once payment is processed and an order confirmation is issued.
• Prices are listed in AUD and include GST unless otherwise stated.
• Tool Room reserves the right to update product descriptions, pricing, and availability at any time without notice.  

3. Shipping and Delivery  

• Orders are dispatched every Tuesday.
• Delivery timeframes are estimates only. While we endeavour to meet them, delays may occur due to postal or courier services, customs clearance, or events beyond our control.
• Customers are responsible for providing accurate delivery details. Tool Room is not liable for parcels lost due to incorrect or incomplete information.  

4. Returns and Refunds  

• Your rights under the Australian Consumer Law (ACL) are fully protected.
• If a product is faulty, unsafe, significantly different from its description, or otherwise fails to meet consumer guarantees, you are entitled to a remedy. This may include a refund, replacement, or repair, depending on the severity of the issue.
• For minor issues, Tool Room may choose to repair or replace the item. For major failures, you may elect a refund or replacement.
• Refunds are not available for change of mind, except as required by law.  

5. Intellectual Property  

• All designs, images, text, and other content on this website are the property of Tool Room (trading as Gaffa Creative Precinct) or our content partners.
• This material includes, but is not limited to, the website design, layout, appearance, and graphics.
• Reproduction, distribution, or exploitation for commercial purposes is prohibited without prior written consent.
• All trademarks reproduced on this website, which are not the property of or licensed to Tool Room, are acknowledged.

• Tool Room (trading as Gaffa Creative Precinct) complies fully with Section 18 of the  Australian Consumer Law (ACL), which prohibits misleading or deceptive conduct.
• Product descriptions, marketing materials, and promotional offers are intended to be  accurate and transparent.
• Statements such as “no refunds” or “faulty goods excluded” are unlawful and will never override your statutory rights.  

8. Dispute Resolution  

• If you experience an issue with your purchase, please contact us first at supplies@gaffa.com.au so we can resolve it promptly.
• If the matter cannot be resolved, you are entitled to lodge a complaint with NSW Fair Trading or escalate the dispute to the NSW Civil and Administrative Tribunal (NCAT).  

9. Amendments  

• Tool Room may amend these Terms and Conditions from time to time.
• Updates will be published on this page, and continued use of our website following any amendments will be deemed acceptance of the revised terms.
